Really angry!
Hi...I need to vent. I went to school today to check on my COBRA paper work. While in the HR office, she told me that that there would be no severance and that included my sick leave payout. I have been at that friggen school for 23 years....22 years full time and 1 year at 60%. I hardly ever used my sick leave or very few of them. They are going to pay me 50% of what is due to me based on my 60% year, not on my 22 years as a full time employee....I am soooo mad...I came home and My neighbor came over for coffee and that helped. What a S***** deal! When I calm down I will e-mail my boss.....JJ

Jill,
Sorry to hear how they continue to try to take advantage of you. It sure looks like they were setting you up last year, when they made that cut in your hours. You may need to talk with an attorney who specializes in this sort of case, to see what your chances might be, if you need to file a suit against the school. Most initial consultations are free.
Hugs,
Tex

What a blow to your finances AND your feelings!!! I'm really sorry. Seems like every time you manage a "step up" they knock you down again.
What they are doing doesn't really sound legal. If it is, it shouldn't be.

Is your school a private school? If so, I guess they can make their own policies. Where I worked (public school system) you had to be at least 60 years old and have at least 20 years of service to get reimbursed 50% of your unused sick leave at retirement. If you left for any other reason or didn't meet those criteria you got nada. I agree with everyone, though, that your school has not treated you with the respect and consideration they should, given the fact that you devoted your life to them!!! Boy, is it time to move on.

Hi Jill!
I can not believe this!!!!!!! I'm angry for you!!!!!
Did you have a contract and if so, was there anything in it that verified what they have chosen to do if you go from being full-time to a lesser amount???
I'd be fighting this BIG time!!!!!!
This kind of thing is happening in all kinds of workplaces these days and it makes me sick when I know that alot of people have put in years and years and have been loyal and dedicated to their employers and they end up getting the shaft!! It's a damn SHAME!!!!!!!!!

Hi you guys...my school is a private school and they can do what they want. I am sure the cash-out policy is probably in our employee handbook. I also checked and a company has no obligation what so ever to provide severance. I know they re-did the cash-out policy a couple of years ago. The problem is....the people in the finance office are new and have no problem what so ever telling me what I don't get. There have been various law suits against the school in the past and the school brings in the big guns. I don't stand a chance. I see this more as a moral fight, not a legal one. They can treat me like dirt if they want, and as long as it is in writing, I don't have a pot to pee in.
I had terrible pains in my stomach and lower back last night....couldn't go to dinner with my sis. I woke up with pains again this morning, but put a heating pad on my back and tummy....took Gas-X and an Aleve. I am better....but have no zip! TTFN....JJ

A little different situation, but still insurance problem...
I'm VERY upset today too! I found out today that when our insurance changed in March to Disability/Retirement that I was supposed to pick up my Medicare part B! We specifically asked that question and were told NO, I didn't need to until my husbands' kicks in next April so I didn't get it (I've been eligible for 8 years) and now when my ER bill for my colitis attack, my Colonoscopy, Doctor bills and two trips to the blood lab come through they are only paying 20%! I'm newly diagnosed. I'm hopping mad and now I have to write an appeal which I know they will deny as they always do. I mean, do they think I wouldn't pick up my Part B if I knew they would only pay 20%???? We can't afford these bills. I called Medicare and even the guy there doesn't know what to do about it, if they might be able to go retro-active for me or not. I'm crossing everything that for once the government will be nice and help me out here!

Hi Poopsie,
I believe that SS is required by law to allow you to correct this situation by registering late, and they are obligated to provide retroactive coverage for their percentage of your expenses. Consider this quote, from a website maintained by the Medicare Rights Center:

If you go to: Interesting Cases/Medicare Basics/Part B Premium and Enrollment, you will find a number of example cases listed. The second one is very similar to your situation:

There may be some other example cases that also fit, but I didn't bother to read past the second one. If you need any additional information, please don't hesitate to ask.2. Mr. B is an American citizen who resided in Hong Kong for a number of years. Prior to his 65th birthday, Mr. B visited the American consulate in Hong Kong to inquire about the eligibility requirements for Medicare and was told that he would not be eligible to receive benefits until he was 70 years old. Mr. M believed this erroneous information and did not sign up for Part B during his initial enrollment. Shortly thereafter he returned to the United States and was diagnosed with esophageal cancer. In need of health insurance to pay for his urgent cancer treatment, Mr. M sought help from MRC. MRC staff informed Mr. M that pursuant to federal regulations, when nonenrollment in Part B of the Medicare program is "unintentional, inadvertent, or erroneous and is the result of the error, misrepresentation, or inaction of an officer, employee, or agent of the Federal Government, or its instrumentalities…" Social Security must grant that individual a waiver of the enrollment period and allow retroactive enrollment in Part B. Mr. M's brother, who is an attorney, will help him to appeal. September 2000.
